Breaking new ground with ADUs

The City and County of Honolulu has signed into law the rules governing the construction of smaller homes on residential properties in Honolulu. Accessory Dwelling Units have been accepted with certain restrictions and soon will be coming to a neighborhood near you. There is a major shortage of affordable housing on Oahu, especially rental housing. This new change allows the construction of an ADU, a second attached or detached home from the primary dwelling unit on the zoning lot with its own kitchen, bedroom and bathroom facilities. Review will be subject to meeting the Land Use Ordinance provisions.
ADUs would allow a maximum of 400 square feet for lots ranging between 3,500 square feet and 4,999 square feet and up to 800 square feet for lots 5,000 square feet and up, provided there is adequate infrastructure. The ADUs are similar but not synonymous with Ohana Dwelling Units. The key difference is that ADUs will allow occupancy by non-family members, and in most cases would only require a single off-street parking space unless you live in close proximity to the rail project. Communities governed by associations will not be permitted to participate.
New Ohana Dwelling Units on certain residential properties have been approved for many years and in some areas they still are eligible. What is an Ohana Dwelling Unit? It is a second home permitted on a lot where zoning normally allows for only one. These units restrict occupancy to family members, have no size limitations other than property setbacks, height limitations and lot coverage requirements. They require two off-street parking areas. A separate water and electric meter may be installed.
